Jama3etna — Instructor Terms & Conditions (Individual)

These Instructor Terms & Conditions ("Instructor Terms") form a binding supplement to the Jama3etna Platform Terms of Service. By registering as an instructor, submitting course content, or activating a course for sale on Jama3etna, you confirm that you have read, understood, and agreed to these Instructor Terms in full. Where these Instructor Terms conflict with the general Platform Terms of Service, these Instructor Terms shall prevail with respect to instructor-specific matters.

1. Definitions

  • Instructor means the individual natural person who registers and operates an instructor account on Jama3etna and is the sole responsible party for all content, conduct, and obligations arising from that account.
  • Course means any video-based, text-based, or multimedia educational programme created and submitted by an Instructor for publication on the Platform.
  • Platform means the Jama3etna web and mobile application, including all associated services and infrastructure operated by Jama3etna.
  • Enrolment Revenue means the gross proceeds collected from students who purchase a Course, before deduction of Platform Fees and any applicable payment processing charges.
  • Platform Fee means Jama3etna's commission deducted from Enrolment Revenue as a condition of hosting and selling the Course, the rate of which is communicated at onboarding and may be updated in accordance with Section 12.
  • Net Revenue means the Enrolment Revenue remaining after deduction of the Platform Fee and any applicable payment processing fees, payable to the Instructor.
  • Student means any end-user who has purchased or enrolled in a Course.

2. Instructor Account and Eligibility

2.1 Individual Account

An individual Instructor account may only be registered by, and must correspond to, a single natural person. The account is non-transferable. You may not share your credentials, operate under another person's identity, or register multiple individual accounts.

2.2 Eligibility

To register as an individual Instructor, you must:

  • Be at least 18 years of age;
  • Have the legal capacity to enter into a binding commercial agreement;
  • Not be subject to sanctions or export restrictions that would prohibit your participation; and
  • Possess genuine expertise, credentials, or professional experience relevant to the subject matter of any Course you publish.

2.3 Responsibility

As an individual Instructor, you are the sole responsible party for all content submitted under your account, all representations made to Students, all tax obligations arising from your earnings, and all communications and disputes with Students. Jama3etna does not act as your agent, employer, or representative.

3. Course Content Standards

3.1 Quality Requirements

All Courses submitted for publication must meet the following minimum standards:

  • Accurately described in the course title, summary, and learning objectives;
  • Professionally presented, with clear audio and video quality where applicable;
  • Substantively complete — not promotional, incomplete, or serving primarily as a lead-generation tool;
  • Delivered in full accordance with the advertised curriculum and format; and
  • Updated by the Instructor on a reasonable basis to ensure content accuracy.

3.2 Prohibited Content

Courses must not contain:

  • False or misleading claims, testimonials, or results;
  • Content that infringes any third-party intellectual property right;
  • Material that is discriminatory, harassing, defamatory, or otherwise unlawful;
  • Pyramid schemes, financial advice requiring professional licensing without the appropriate disclaimers, or content otherwise prohibited by applicable law; or
  • Embedded promotions or affiliate links that are not disclosed to Jama3etna in advance.

3.3 Approval and Rejection

Jama3etna reserves the right to review, approve, reject, or request revisions to any Course at any time, without prejudice to Courses already published. Rejection of a submission does not constitute a right to compensation. Jama3etna will provide written reasons for rejection where practicable.

4. Intellectual Property

4.1 Ownership

You retain full ownership of all original intellectual property in your Course content. Nothing in these Instructor Terms transfers ownership of your content to Jama3etna.

4.2 Licence Granted to Jama3etna

By submitting a Course for publication, you grant Jama3etna a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, distribute, translate, subtitle, and market the Course solely for the purpose of operating the Platform and promoting the Course to potential Students. This licence continues for the duration that the Course remains published on the Platform and terminates upon full removal of the Course, subject to Section 4.3.

4.3 Residual Access

Students who have enrolled and paid for a Course prior to its removal retain their access rights for the period originally advertised. You acknowledge and agree to this residual access obligation. Jama3etna may continue to host the Course solely to fulfil this obligation.

4.4 Instructor Warranties

You warrant that:

  • You are the sole owner or a duly authorised licensee of all content submitted;
  • The content does not infringe any third-party intellectual property, privacy, or moral rights; and
  • You have obtained all necessary consents and clearances for third-party materials incorporated in the Course.

5. Revenue Share and Payouts

5.1 Platform Fee

Jama3etna charges a Platform Fee on all Enrolment Revenue. The applicable rate is confirmed in writing at the time of instructor onboarding. Jama3etna reserves the right to adjust the Platform Fee upon 30 days' written notice to the Instructor.

5.2 Net Revenue Payment

Jama3etna will pay Net Revenue to the Instructor on a monthly basis, provided the payable balance meets the minimum payout threshold communicated at onboarding. Payments will be made to the bank account, payment platform, or other method designated by the Instructor at account registration.

5.3 Deductions

The following may be deducted from Net Revenue prior to payment:

  • Student refunds processed in accordance with Section 7;
  • Payment processing fees charged by third-party processors; and
  • Any amounts owed by the Instructor to Jama3etna under these Instructor Terms.

5.4 Tax Obligations

You are solely responsible for determining and fulfilling all tax obligations arising from your Net Revenue, including income tax, VAT, and any other applicable taxes in your jurisdiction. Jama3etna does not withhold or remit taxes on your behalf unless required to do so by law.

6. Pricing and Promotions

You set the listed price for your Course, subject to Jama3etna's minimum and maximum pricing guidelines communicated at onboarding. Jama3etna may include your Course in platform-wide promotional campaigns, discount programmes, or bundle offers. Where such inclusion materially affects pricing, Jama3etna will notify you in advance. Continued publication of the Course following notification constitutes acceptance of the promotional terms.

7. Student Refund Policy

Jama3etna operates a 30-day satisfaction guarantee for Students on new enrolments, unless a shorter period is specified and agreed in writing for a particular Course. Refunds granted within this period will be deducted from the Instructor's Net Revenue. Refunds arising from Instructor error, misrepresentation, or technical failure attributable to the Course are the Instructor's financial responsibility. Jama3etna's decision on refund eligibility is final.

8. Student Communication and Conduct

You are responsible for responding to Student questions and feedback in a timely, professional, and accurate manner. You must not use student contact information for any purpose other than direct, course-related communication through the Platform. Solicitation of students for off-platform services, upselling without disclosure, or any conduct that undermines the student experience is prohibited and may result in account suspension.

9. Certificates

Where Jama3etna issues certificates of completion to Students on your behalf, the certificate is conditional on the Course meeting Jama3etna's certification standards. You must not independently represent the certificate as conferring any professional licence, accreditation, or qualification unless the Course holds formal accreditation from a recognised body, which must be disclosed and verified with Jama3etna prior to publication.

10. Account Suspension and Termination

10.1 Instructor-Initiated Termination

You may close your instructor account and remove your Courses from the Platform at any time by providing 30 days' written notice to Jama3etna. Courses remain accessible to enrolled Students during this period and for the duration of their purchased access, as described in Section 4.3.

10.2 Jama3etna-Initiated Suspension or Termination

Jama3etna may suspend or terminate your account, with or without notice, in the event of:

  • Material breach of these Instructor Terms or the Platform Terms of Service;
  • Sustained student complaints or ratings falling below platform-minimum thresholds;
  • Publication of content that violates applicable law or Jama3etna's content policies;
  • Fraudulent activity, misrepresentation, or conduct damaging to the Platform or its users; or
  • Any circumstances that Jama3etna reasonably determines to be harmful to the Platform community.

10.3 Effect of Termination

Upon termination, your access to the instructor dashboard ceases immediately. Net Revenue accrued to the date of termination will be paid out in the next regular payment cycle, subject to any deductions or disputes outstanding at that time.

11. Limitation of Liability

To the fullest extent permitted by law, Jama3etna's liability to an individual Instructor arising from or in connection with these Instructor Terms is limited to the total Net Revenue paid to that Instructor in the three months preceding the event giving rise to the claim. Jama3etna is not liable for loss of expected revenue, reputational harm, or any indirect or consequential loss.

12. Amendments

Jama3etna reserves the right to amend these Instructor Terms at any time. Material changes will be communicated in writing with a minimum of 14 days' notice. Continued publication of Courses after the effective date of an amendment constitutes acceptance of the updated terms. If you do not accept an amendment, you may terminate your account in accordance with Section 10.1 prior to the effective date.

13. Governing Law and Disputes

These Instructor Terms are governed by the laws of the Republic of Lebanon. Any dispute arising from or in connection with these terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts in Beirut, Lebanon.
